Privacy Policy

GENERAL

Weight Unlocked (“Company,” “we,” “us,” or “our”) publishes this Privacy Policy for users (“user” or “you”) of our websites, mobile sites, mobile applications, and related services (collectively, the “Website”). This Privacy Policy explains the types of information we collect, how we use and disclose it, and your rights regarding that information. The current version of this Privacy Policy applies each time you use the Website; please review it regularly for changes.

Notice to Users Outside the United States

The Website is hosted in the United States and is subject to U.S. state and federal law. If you access the Website from other jurisdictions, you may be transferring your personal information to the United States. By using the Website, you consent to that transfer and to the use of your personal information in accordance with this Privacy Policy. You agree to abide by applicable U.S. state and federal laws. If use of the Website would be unlawful in your jurisdiction, please do not use the Website. Your jurisdiction may offer a different level of protection for your data.

BY USING OR ACCESSING THE WEBSITE, YOU ACCEPT THE PRACTICES DESCRIBED IN THIS PRIVACY POLICY.

GATHERING, USE, AND DISCLOSURE OF NON‑PERSONALLY IDENTIFYING INFORMATION

“Non‑Personally Identifying Information” is information that, without the aid of additional information, cannot be directly associated with a specific person. “Personally Identifying Information,” by contrast, is information such as a name or email address that, without more, can be directly associated with a specific person.

Like most website operators, we gather Non‑Personally Identifying Information made available by web browsers, depending on their settings. This may include your Internet Protocol (IP) address, operating system, browser type, and the locations of the websites you view before arriving at, while navigating, and after leaving the Website. Although such information is not Personally Identifying Information, it may be possible to determine your internet service provider and the approximate geographic location of your point of connectivity as well as other statistical usage data. We analyze Non‑Personally Identifying Information to help us better understand how the Website is being used and to improve content and usability.

From time to time, we may release aggregated Non‑Personally Identifying Information, such as publishing a report on trends in Website usage.

Web Cookies

A “Web Cookie” is a small text file that assigns you a unique identification and is stored on your device. We use cookies to keep track of services you have used, record registration information, remember your preferences, keep you logged in, and facilitate purchases. We also use cookies to track the pages you visit during a session, both to improve your experience and to understand how the Website is used. We may analyze and disclose aggregated information gathered using cookies.

USERS WHO DO NOT WISH TO HAVE COOKIES PLACED ON THEIR DEVICES SHOULD SET THEIR BROWSERS TO REFUSE COOKIES BEFORE ACCESSING THE WEBSITE, UNDERSTANDING THAT CERTAIN FEATURES MAY NOT FUNCTION PROPERLY WITHOUT COOKIES. REFUSING COOKIES MAY RESULT IN LOSS OF FUNCTIONALITY.

“Device fingerprinting” can track devices over time based on browser configurations and settings, even without cookies. For more information, please see: https://www.consumer.ftc.gov/articles/0042-online-tracking

Web Beacons

A “Web Beacon” is an object embedded in a web page or email that allows operators to check whether a user has viewed a particular page or email. We may use Web Beacons on the Website and in emails to count users who have visited certain pages or viewed emails and to deliver co‑branded services. Web Beacons are not used to access your Personally Identifying Information. They collect a limited set of information such as a cookie number, time and date of a page or email view, and a description of the page or email on which the beacon resides. You cannot decline Web Beacons, but they can be rendered ineffective by declining all cookies or adjusting your browser settings to notify you each time a cookie is offered.

Analytics

We may use third‑party vendors, including Google, who use first‑party cookies (such as the Google Analytics cookie) and third‑party cookies (such as the DoubleClick cookie) together to inform, optimize, and serve ads based on your past activity on the Website, including Google Analytics for Display Advertising. The information collected may be used to analyze and track data, determine the popularity of certain content, and better understand online activity. If you do not want information collected and used by Google Analytics, you can install a browser add‑on (https://tools.google.com/dlpage/gaoptout) and/or opt out of Google Analytics for Display Advertising or the Google Display Network using Google’s Ads help (https://support.google.com/ad/answer/262922?hl=en).

Aggregated and Non‑Personally Identifying Information

We may share aggregated and Non‑Personally Identifying Information under any of the above circumstances. We may also share it with third parties and our affiliate companies to develop and deliver targeted advertising on the Website and on third‑party websites. We may combine Non‑Personally Identifying Information we collect with additional Non‑Personally Identifying Information from other sources. We may also share aggregated information with third parties, including advisors, advertisers, and investors, for general business analysis. This information does not contain Personally Identifying Information and may be used to develop content and services and to target content and advertising. In addition, we may make use of de‑identified information in accordance with applicable law.

Mobile Device Additional Terms

Mobile Device. If you use a mobile device to access the Website or our applications, we may collect device information (such as your device ID, model and manufacturer), operating system, version information, and IP address.

Geo‑Location Information. Unless we have received your prior consent, we do not access or track location‑based information from your mobile device while using our mobile application or services, except that it may be possible to determine from an IP address the general geographic location of your point of connectivity.

Push Notifications. We may send push notifications if you choose to receive them (e.g., service‑related notices). You may turn them off in your device settings.

Mobile Analytics. We may use mobile analytics software to better understand functionality of our mobile software. This software may record information such as how often you use the application, events that occur within the application, aggregated usage, performance data, and where the application was downloaded from. We may link information stored within analytics software to some Personally Identifying Information you submit.

SOCIAL MEDIA

We may provide the option to connect your Website account to your accounts on social networking sites for logging in, uploading information, or enabling features. When logging in using social credentials, we may collect Personally Identifying Information you have made public on the social network (e.g., name, profile picture, username, gender, age range, locale, and friend list). Once connected, other users may also be able to see information about your social network. By connecting accounts, you consent to the continuous release of information about you to us. We will not send any account information to the connected social network without first disclosing that to you. Features and shared information are subject to change by us and the social networks.

The Website may include social plugins and hyperlinks (e.g., Facebook “Like,” X/Twitter “Tweet,” Google). When you click these, your browser connects directly to the provider’s servers, which may receive information such as your IP address, browser version, screen resolution, and operating system. Privacy settings for these services can be found on their respective sites and are not under our control.

Online Postings. Certain Personally Identifying Information may be disclosed as a matter of course through your use of the Website (e.g., reviews or public posts). Such postings are governed by our Terms of Use and may appear on other websites or in search results. Whenever you voluntarily disclose personal information on public pages, that information can be collected and used by others. Use discretion and caution with your personal information. USERS ASSUME ALL RESPONSIBILITY FOR ANY LOSS OF PRIVACY OR OTHER HARM RESULTING FROM VOLUNTARY DISCLOSURE OF PERSONALLY IDENTIFYING INFORMATION.

Company Disclosures

By Law or to Protect Rights. We may disclose Personally Identifying Information to investigate, prevent, or take action regarding illegal activity, suspected fraud, or other wrongdoing; to protect the rights, property, or safety of Company, users, employees, or others; to comply with applicable law or cooperate with law enforcement; to enforce our Terms of Use or other policies; in response to subpoenas, court orders, or government requests; to establish or exercise legal rights; or to defend against legal claims.

Third‑Party Marketing Communications. Unless you opt out, we may provide your email information to third parties so they may contact you about additional products and services. To cease having your email information provided to third parties, adjust account settings (if applicable) or contact us. You may continue to receive marketing emails from third parties already given your information; you will need to contact those third parties directly to stop further emails.

Third‑Party Service Providers. We may share your Personally Identifying Information (including name and contact information) with authorized service providers who perform services on our behalf (e.g., order fulfillment, customer service, marketing assistance, analytics, payment processing, Website functionality, contests, and surveys). These providers may access personal information needed to perform their functions but are not permitted to share or use such information for other purposes. We may transfer personal data to processors located outside the U.S. (e.g., the United Kingdom). Our collection, storage, access, and use of your personal data will continue to be governed by this Privacy Policy. By using the Website, you consent to such transfers.

Business Transfers; Bankruptcy. We may disclose Personally Identifying Information to a successor organization in the event of a merger, acquisition, bankruptcy, or other sale of assets. Unless otherwise ordered by a court, the use and disclosure of transferred information will be subject to this Privacy Policy or a new privacy policy, if you are given notice and an opportunity to opt out.

Employees, Contractors, and Consultants. Some employees, contractors, and consultants (e.g., health or lifestyle coaches) may have limited access to your personal information to provide services to you, troubleshoot problems, or resolve complaints. Access is limited to what is reasonably necessary to perform their functions or improve services.

Your Ability to Change Personally Identifying Information; Account Termination

You may review or change your Personally Identifying Information at any time via account settings (if applicable) or by contacting us using the information below. Upon request, we will deactivate or delete your account and contact information from our active databases as soon as practicable, subject to our deactivation policy and applicable law. We may retain certain information to prevent fraud, troubleshoot problems, assist investigations, enforce our Terms of Use, or comply with legal requirements. We may also keep a history of changed information to investigate suspected fraud.

Children’s Personally Identifying Information

Our services are not intended for anyone under 13 years of age. We do not knowingly collect Personally Identifying Information from children under 13, other than minor children receiving the service through registration by a parent or legal guardian. If you are under 13, do not use the Website. If you are a parent or guardian and believe a child under 13 has disclosed Personally Identifying Information to us, please contact us at [email protected]. A parent or guardian may review and request deletion of such child’s information and prohibit its use.

COLLECTION AND USE OF INFORMATION BY THIRD PARTIES GENERALLY

We contractually prohibit our vendors, suppliers, employees, and contractors from disclosing Personally Identifying Information received from us other than as permitted by this Privacy Policy. However, third parties are not obligated to comply with this Privacy Policy with respect to information you provide directly to them or that they collect independently. These third parties may include licensed practitioners, physicians, naturopaths, dieticians, nutritionists, advertisers, and providers of games, utilities, widgets, and other third‑party applications accessible through the Website. We neither own nor control third‑party websites and applications. Before visiting a third‑party site or using a third‑party application (whether via a link on the Website or otherwise), and before providing any Personally Identifying Information to any such third party, you should review that third party’s privacy policy and terms of use and take steps you deem necessary to protect your privacy.

SECURITY

We use reasonable electronic, personnel, and physical measures to protect information from loss, theft, alteration, or misuse. However, even the best security measures cannot eliminate all risks. We cannot guarantee that only authorized persons will view your information or that third parties will not circumvent privacy settings or security measures. You are responsible for maintaining the confidentiality of your password and account information. Change your password immediately if you believe it has been compromised and notify us if you lose control of your account.

There is always some risk that transmissions over the Internet may be intercepted or that unauthorized third parties may find a way around our systems. We do not utilize encryption systems for emails from us to you. We therefore make no representations or warranties regarding the sufficiency of these measures. No data transmission over the Internet or through mobile devices can be guaranteed to be 100% secure. While we strive to protect your personal information, we cannot ensure or warrant the security of information you transmit to us. It is your responsibility to protect the security of your login information. We are not responsible for any damages resulting from a security breach or technical malfunction.
